The focus should be on how to best (How To Fire Employees)

The focus should be on how to best bring around a worker that is out of line. If the problems do not increase, dismissing the worker may be your only choice. Also in the past several decades, company downsizing has become more common. After carefully reviewing the previous warnings dated [list dates], which were for the following grievances [list grievances], we have decided to dismiss your worker effective immediately. If you want to revoke the agreement, I must get a written warning within this time. In a Cornell University study a few years ago, researchers found the bad handling of a dismissal meeting and its aftermath was the primary cause for a illegal separation suit. Dealing with worker insubordination is a difficult task. A worker who displays insubordinate behavior refuses to follow orders from a superior. However, you don't have to tell the worker of this right, and the representative can only be a jobholder, not a legal adviser or someone outside the firm. If you find the laid off worker has gotten her legal defender involved unexpectedly, just make a change. Also, if some outside reason causes the jobholder to resign, the unemployment commission would consider this an involuntary dismissal.

It is useful evidence if the jobholder later decides to get even with the company, his or her coworkers or the management. It's best for your Hr department to keep the documentation because the firing supervisor may leave the firm, and the records may become lost. Although this is an oral notification, you should record the date of the conversation and you must notify the employee the conversation is serving as an oral notification and following late arrivals to work will result in a written notification. In either case, misbehavior can lead to further problems with that worker as well as with your other workforce. As a manager or supervisor, you may feel that a worker's actions warrant immediate layoff or sacking them before their contract expires.
